Terms of Service
These Terms of Service (“Terms”) govern your use of the hosting, cloud infrastructure, virtual machines, VoIP services, and related solutions provided by HAPBX Cloud (“HAPBX”, “we”, “our”, “us”). By creating an account at billing.hapbx.com or using any HAPBX service, you agree to these Terms.
1. Services Provided
HAPBX offers cloud hosting, PBX and VoIP solutions, and related infrastructure services. These include but are not limited to:
- Cloud VPS / Proxmox-based virtual machines
- GPU compute servers
- VoIP systems & SIP services
- Networking, firewall, and routing
- Automated billing, invoicing, and account management via WHMCS
- SMS notifications for account and service updates (non-marketing)
Customers can manage their services through our billing system at billing.hapbx.com.
2. Account Registration
To use HAPBX services, you must create an account on billing.hapbx.com and provide accurate information. You agree to:
- Maintain the security of your login credentials
- Keep your contact and billing information current
- Use strong, unique passwords and enable additional security when available
- Ensure that all activity from your account is authorized
You are responsible for all activities performed through your account.
3. Billing & Payment
Invoices are generated automatically via WHMCS and are available in your customer portal. Unless otherwise stated:
- Payments must be made before service renewal dates
- Overdue invoices may result in suspension or termination of services
- All fees are non-refundable, except where required by law or explicitly stated in writing
- SMS notifications may be sent for invoice reminders, service changes, and important alerts
Accepted payment methods include credit/debit cards, PayPal, and any other options listed in the billing portal.
4. Acceptable Use Policy
You agree not to use HAPBX services for any of the following:
- Sending spam, phishing, malware, or other abusive traffic
- Hosting or distributing illegal, infringing, or harmful content
- Attempting to disrupt or attack networks, servers, or other infrastructure
- Hosting services in violation of U.S., EU, or local laws and regulations
- Reselling services in ways that violate these Terms or our policies
We reserve the right to suspend or terminate accounts involved in abuse, security threats, or other violations, with or without notice.
5. Messaging & SMS Policy
HAPBX may use SMS and other channels to deliver important account and service information. These messages are strictly transactional and may include:
- Service activation or deactivation notices
- Invoice and payment reminders
- Security alerts and login notifications
- One-time passwords (OTP) and verification codes
- Critical system status or maintenance updates
We do not use SMS for marketing or promotional campaigns under this policy. You may opt out of SMS at any time by replying STOP to a message. Reply HELP to receive assistance information.
6. Data & Privacy
We collect and process customer data as described in our Privacy Policy. HAPBX will not sell or rent your personal information. Data is used solely to provide and improve our services, comply with legal obligations, and protect our systems and customers.
7. Service Availability
HAPBX aims to provide reliable, enterprise-grade uptime. However, we do not guarantee uninterrupted service. We are not responsible for downtime or service impact caused by:
- Internet provider or upstream carrier failures
- Customer-side misconfiguration or hardware failure
- Third-party service outages (e.g., datacenter, cloud, carrier)
- Force majeure events such as natural disasters or other events beyond our control
8. Termination
We may suspend or terminate your account or services if:
- You fail to pay invoices when due
- You violate these Terms or our Acceptable Use Policy
- Your use of the service poses a security, legal, or operational risk
You may cancel services at any time via the billing portal. Upon cancellation, you are responsible for any unpaid fees up to the effective cancellation date.
9. Limitation of Liability
To the maximum extent permitted by law, HAPBX is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the services is limited to the amount you paid to HAPBX for the affected service in the 30 days preceding the event giving rise to the claim.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the services after any update constitutes your acceptance of the revised Terms.
